PA Court of Common Pleas — All Interested Parties Must Be in the DJ.

Section 7440(a) of the Declaratory Judgment Act requires all interested parties to be joined in a declaratory judgment action — or relief cannot be granted. In the case of Mine Safety Appliances Co. v. Century Indemnity Co., PICS Case No. 07- 2016, (which arises out of the manufacture of allegedly defective respiratory protection products) a Court of Common Pleas judge denied the insurer’s motion for failure to name all interested parties — which in this case included people who have not yet been identified, but someday might come forward with a claim or lawsuit.
