PA Superior Court — 1311.1 Evidentiary Standard Requires Party Willing to Testify.

Pa.R.Civ.P. 1311.1 allows for the relaxation of medical record authentication standards. In the case of Gaston v. Minhas, PICS Case No. 07-1989, however, the Superior Court rebuked the trial court’s relaxation because the chiropractor whose records were to be introduced refused to testify at trial — citing the 5th Amendment.
