WCM Awarded Summary Judgment Dismissal in Philadelphia Premises Case.

Partner Bob Cosgrove and associate Erica Woebse were awarded summary judgment dismissing all claims in a Philadelphia premises liability case. In McCollum v. Gulle et al., the plaintiff alleged that she tripped and fell down the cement landing and front steps shared by Jean Paul Gulle – whose property was managed by Disston Realty – and Christian and Helen Shelinsky, our clients. While the plaintiff claimed that our clients’ “good neighbor” behavior of shoveling snow from the shared landing created a question of fact as to whether our clients were “in control” of the property where the accident occurred, we argued (through expert testimony) that the evidence was clear that our clients did not own the property where the plaintiff fell. The trial court agreed and dismissed all claims against our clients.
