Partner Cheryl Fuchs and associate Alicia Sklan obtained pre-discovery summary judgment in a Bronx County Labor Law case. In Carrasco v. HBSL Partners LLC, the plaintiff fell off of a scaffold at a construction site.  Though our client installed exterior scaffolding at the building, we moved to dismiss the complaint on the basis that our client’s scaffolding was removed several months prior to the accident.  Rather than proceed through the lengthy and expensive discovery process, we made a strategic decision to aggressively move for summary judgment pre-depositions, and achieved early dismissal for our client.
